These Terms of Service (“Terms”) govern your access to and use of the Pink Plate analytics platform, websites, and related services (collectively, the “Service”) provided by Pink Plate (“Pink Plate,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service

Pink Plate is an AI-powered analytics platform that connects to your business data sources, surfaces the metrics that matter, explains why they moved, and recommends actions. We may add, change, or remove features of the Service from time to time.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Your data and responsibilities

You retain all rights to the data you connect to or submit through the Service (“Customer Data”). You grant us a limited, non-exclusive license to access, process, and display Customer Data as necessary to provide and improve the Service. Third-party services

Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by Pink Plate and its licensors and is protected by intellectual property laws. AI-generated insights

The Service uses automated and AI-based methods to generate metrics, alerts, and recommendations. These outputs may contain errors or omissions and are provided for informational purposes only. They are not professional, financial, legal, or accounting advice. You are responsible for reviewing and independently verifying any output before relying on or acting on it.

Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Pink Plate and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service will not exceed the amounts you paid to us for the Service in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Pink Plate and its affiliates from any claims, damages, liabilities, and expenses arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe doing so is necessary to protect the Service or other users. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply.

Governing law

These Terms are governed by the laws of the United States and the state in which Pink Plate is established, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located there.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
